It Is A Truth: A Totally No Cost Credit File Is Your Right By Law
Yes, you have a right to receive a totally free credit file from every one of the three credit reporting organizations in the United States. Your right to receive a totally free credit file is a federal public law, precisely, public law 108-159. When trying to figure out how to get rid of credit card debt, this can be an invaluable tool. The law that made a totally free credit file for customers a right was passed by The 108th Congress on December 5, 2005. It was specifically aimed at people trying to maintain good credit or going down the road of how to get rid of credit card debt. It is called the Fair and Accurate Credit Transaction Act (FACT) of 2005, and it's a Godsend for individuals for whom used cars is an extremely real concern.
The Act amended an earlier credit file law called the Fair Credit Reporting Act. FACT amended the Fair Credit Reporting Act to include a provision for the absolutely free credit file. In Title II of FACT, under section 211, which is called "No cost consumer Records", all credit reporting organizations are required to give customers their credit files once during a one year period "upon the demand of the consumer without charge to the consumer”. This law reversed the practice of credit reporting organizations to charge customers for their own credit file.
FACT goes on in Title II to state that the consumer may obtain the absolutely free credit file only if the consumer makes that demand from a centralized source that a government commission would supervise in its expansion. At minimum, credit reporting organizations are required to provide a toll free number customers may call to make their appeal. It also states that credit reporting organizations have 15 days in which to provide the absolutely free credit file to the consumer after the consumer has made the appeal.
FACT also states that customers may also apply for a reinvestigation of the details of their credit file after they get it and that credit reporting organizations must finalize that investigation within 45 days after a demand for reinvestigation. This assures that customers may use the absolutely free credit file after they get the results of the reinvestigation.
The three credit reporting organizations in the U.S., Equifacts, Experian, and Transunion, together formed a centralized source that customers can use to ask for their credit file as required by FACT.
